Child Support Guidelines
In Pennsylvania, the State Supreme Court has established guidelines that govern how child support payments are calculated. The guidelines were developed using The Income Shares Model which is based upon the concept that the child of separated, divorced or never-married parents should receive the same proportion of parental income that a child would receive in a situation where parents live together.
For the most part, the parent that does not have primary custody (the non-custodial parent) is required by law to provide the child financial support until the child graduates from high school or turns 18, whichever occurs later. There are exceptions to this, however any deviations from guideline payment amounts, must be granted by the courts.
It is important to note that if you have been court ordered to pay child support and you fall behind in payments or fail to make them at all, the state will seek enforcement of a child support order. By retaining The Law Office of David C. Berman, you can ensure that your rights are protected and all of your options for responding to enforcement actions are explored.
Similarly, if you are owed child support, The Law Office of David C. Berman, can help you more quickly recover your past due child support as well as help you seek the total amount of money due to you.
Modification of Child Support
A change in circumstances (such as an increase or decrease in income) of either parent may result in child support payments being modified. The modification is not automatic, and the parent seeking a change in child support must contact an attorney to file a motion requesting a modification of the child support order.
Private Agreements on Child Support
Parents may make arrangements outside of court regarding the payment of child support. While this may appear to be an easy way to establish and make changes to child support payments, such informal agreements may not be legally binding. The filing of a child support claim establishes the date on which child support payments should start accruing. Without formal filing of a child support claim, the parent seeking support may not be able to collect the full amount of back support payments due to them. Also without a formal child support court order, a parent may not have legal grounds upon which to seek enforcement of the privately established support agreement.
PACSES
The Pennsylvania Child Support Enforcement System (PACSES) is the statewide system that is used to monitor and enforce child support orders. For more information, please see the PACSES website.
